Terms of Service

By using Captuvics ("the Service") you agree to these terms. The Service is provided by Captuvics, Inc. Email [email protected] with questions.

1. The service

We provide a platform to create events, collect photos and videos from participants, and share the resulting galleries. Features and limits depend on your plan.

2. Your account

You must be 13+ to use Captuvics. You are responsible for keeping your credentials secure and for activity on your account. Notify us immediately of any unauthorized use.

3. Your content

You retain ownership of all content you upload. You grant Captuvics a worldwide, non-exclusive, royalty-free license to host, display, transmit, and back up your content for the purpose of operating the Service. We do not claim ownership and we do not use your content for marketing without your explicit permission.

You promise that:

• You have the right to upload all content (you took the photo, or have the rights from the person who did).
• The content does not violate any third-party rights or applicable law.
• The content is not unlawful, defamatory, harassing, or contains malware.

4. Acceptable use

You may not:

• Use the Service to upload illegal content (CSAM, malware, copyright violations).
• Attempt to bypass plan limits, abuse rate limits, or scrape content from events you don't have access to.
• Reverse engineer, resell, or sublicense the Service.
• Use the Service to spam or harass others.

Violations may result in account suspension or termination.

5. Plans and billing

Free plans are subject to limits described on the pricing page. Paid plans renew automatically unless cancelled. You can cancel any time; access continues through the end of the paid period. Prices may change with 30 days' notice; you may cancel before the change takes effect.

6. Termination

You may delete your account at any time. We may suspend or terminate access for material breach of these terms, with notice where reasonably possible. On termination we will provide an export of your content for 30 days, then delete it.

7. Warranties and liability

The Service is provided "as is" without warranties beyond those required by law. To the maximum extent allowed, our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages.

8. Governing law

These terms are governed by the laws of the State of Delaware, USA. Disputes will be resolved in the state or federal courts of Delaware, except where prohibited by law.

9. Changes

We may revise these terms. Material changes will be announced 30 days before they take effect. Continued use after the effective date constitutes acceptance.
